North Carolina State Representative Gregory F. Murphy said that infants who survive abortion attempts should receive the same treatment as any other child, emphasizing that "neglect is harm" and highlighting the necessity to protect those unable to defend themselves. This statement was made in a January 23 post on X.
"Babies who survive abortion attempts should be taken care of like any other life," said F. Murphy. "As a physician, I am called to do no harm. Neglect is harm, and we must protect those who cannot defend themselves."
The Born-Alive Abortion Survivors Protection Act mandates healthcare practitioners to provide equivalent care to a child born alive after an abortion or attempted abortion as would be provided to any other child of the same gestational age. The legislation also requires immediate hospital admission for the child and obliges healthcare workers to report any failure to meet these care standards to law enforcement. Non-compliance could lead to criminal penalties, including fines or imprisonment for up to five years, according to Congress.gov.

According to Fox News, the House of Representatives passed a bill imposing penalties on doctors who fail to provide life-saving care to infants born alive following an abortion attempt. The bill passed with a vote of 217 to 204, largely supported by Republicans, with one Democrat, Representative Vicente Gonzalez, voting "present." This vote came after the bill's failure in the Senate earlier in the week, where it did not pass a procedural vote requiring 60 votes for further debate.
"I am so grateful the House passed my vital legislation to ensure babies who survive an abortion are afforded lifesaving medical care. Innocent children deserve the opportunity to live and thrive – period," said Wagner in a press release on January 23, 2025.
Murphy is currently serving his third term as representative for North Carolina’s Third Congressional District. He participates in several committees including the House Ways and Means Committee and the House Veterans Affairs Committee. Additionally, he co-chairs the House GOP Doctors Caucus. Murphy holds degrees from Davidson College and the University of North Carolina’s School of Medicine and is recognized as the only practicing surgeon in Congress, according to House.gov.
